Accountable for effective and efficient management and administration of legal collection of arrears and bad debts activities of the Branch in compliance with the Bank’s credit policy and procedures in order to manage the non-performing loans. Through leading collection staff with the aim to keep provisions in acceptable limits and reduce losses to the bank.
Job description

KEY PERFORMANCE AREAS (KPAS)
 
1.    Financial Management
•    Assist the Senior Manager: Legal Collections with the planning and execution of the Branch’s budget and other financial targets
•    Checking of requisitions for payment of creditors on time
•    Ensure that the company targets in respect of non-performing loans are obtained.
•    Ensure the reduction of loss to the Group and increase of revenue through collections and recovery.
•    Manage multiple delinquent accounts though ensuring that no negative impact is caused through IFRIS 9 on the Bank.
 
2.    Legal Collections
2.1    Collection of debts
•    Ensure effective and efficient implementation of the debt collection policy, procedures and processes in compliance with the Bank’s credit policy and procedures.
•    Ensure legal action within delegated limit. 
•    Ensure the reduction of losses to the Group and increase of revenue through collections and recovery.
•    Manage costs/expenses within approved budget to achieve cost efficiencies in the recovery campaigns
•    Identify collection opportunities that will result in asset recoveries, also identify when the cost of collection will outweigh the potential benefit thereof and thus take the strategic decision to write off and relay to third party debt collectors.
•    Maintenance of expert knowledge on relative legislative amendments, industry best practices and provision of proactive advice and solutions to relevant stakeholders.
•    Identify how changes in legislation will affect the collection process and apply strategic changes in a preemptive attempt to lessen the affect of the change in legislation.
•    Translate the strategy into operational business plans for the short, medium and long term within the Department and ensure that performance is monitored, reported and delivered and necessary actions are taken to achieve the strategy and plans
 

2.2    Realisation of securities
•    Ensure effective and efficient realisation of all collateral securities ceded to the Bank in line with the Bank’s policy, procedures as well as applicable legislation 
•    Ensure that all collateral securities are legally valid and that they are kept safely in accordance with the Bank’s policy and procedures. 
•    Effectively managing the institution and duration of legal actions against debtor.
•    Ensure that the court procedures are duly followed and that lawyers adhere to the service level agreement.
•    Ensure legal collections work to attorneys to ensure most optimal legal collections.
•    Ensure that lawyers institute the correct legal actions to avoid costly and lengthy court procedures and manage the court proceeding on day-to-day basis
•    Ensure compliance with national and international laws of realisation of security.
 
 
2.3    Auctions
•    Oversee that auctions are effectively and efficiently conducted in liaison with other internal and external stakeholders.
 
2.4    Write-offs processing and recording
•    Ensuring that bad debts provisions on the financial statements of the bank are managed.
•    Oversee that accounts with no recovery possibilities are written-off in compliance with the Bank’s policies and procedures, as well as applicable legislation.
 
2.5      Liquidation and Estate late accounts
•    Ensure effective and efficient realisation of all collateral securities held by the Bank’s policy, procedures as well as applicable legislation, specifically Insolvency and estate late legislation.  
 
2.5      Judicial Management 
•    Overall responsible for effective and efficient management of accounts under Judicial Management 
 
2.6    Business Rescue:
•    Overall responsible for effective and efficient management of the legal process in Court (if applicable) for business rescue implementations.
 
2.7    Court Procedures:

•    Overall responsible for effective and efficient management of court proceedings and documentations prepared and submitted to court. 
•    Overall responsible for effective and efficient management of court durations and ensuring that all strategy on clients is understood and reflect in the court documentation. 
2.    Relationship Management
•    Assist the Senior Manager: Legal Collection in building and enhancing long-term working relationships with both internal and external stakeholders and clients, e.g. attorneys, branches, etc.
•    Enhance and maintain working relationships with existing clients.
•    Ensure that both internal and external clients are treated in a professional manner at all times.
 
3.    Management of tracing activities
•    Responsible for the management of both internal and external tracing instructions. 
•    Effective and efficient management of both internal and external tracing processes.
•    Responsible for checking various tracing reports and auctions lists.
•    Ensure effective and efficient execution of collection of movable assets.
•    Effective and efficient management of trips related to repossession of movable assets in outside towns.  
 
4.    Management of Collateral Documentation 
•    Ensure effective and efficient management and administration of agreements and collateral documentation in compliance with the Bank’s policies and procedures. For example, following up on insurances, insolvent and deceased estates and bond cancellations.
 
5.    Compliance, Risk and Support
•    Oversee the effective and efficient management and administration of legal collection internal processes and procedures in order to ensure compliance with the Bank’s risk framework to minimise risk.
•    Collaborate with other relevant internal stakeholders such as risk department, internal auditing in managing all risks related to legal collections.

•    Provide support and guidance to various stakeholders such as branches, attorneys, etc. on risk matters related to legal collections.
•    Comply with governance in terms of legislative and audit requirements 
 
6.    People Management
 
•    Provide management and leadership capability in the department.
•    Ensure effective workforce planning and people capacity requirements in the area of responsibility.
•    Responsible for performance and talent management in the area of responsibility.
•    Develop and re-enforce a performance culture in the department.
 
7.    Routine Administration
•    Ensure effective management and control of all routine administrative activities related to legal collection in the branch in compliance with the Bank’s policies, procedures, rules and regulations.
•    Ensure effective and efficient management and submission of admin related reports to relevant stakeholders.

8.    General
Must be prepared /willing to do any other reasonable and lawful instruction/task and ensure that it is normally carried out on time and correct.

Minimum requirements

EXPERIENCE/KNOWLEDGE & SKILLS
•    At least 8 years experience in a legal collection environment.
•    Knowledge of debt collection in a banking environment will be an added advantage.
•    Proficiency in computer user skills

QUALIFICATION
•    LLB Honours qualification with a minimum 8 years management experience  
•    Admission in the High Court and Supreme Court of Namibia 
•    Leadership experience of 8 years and course
