Minimum requirements
1. Management Focus
1.1 Responsible for the execution of decisions made regarding:
- Compliance with credit legislative requirements
- Credit litigation management.
- IFRS-9 Provision for bad debt.
- Settlement proposals and negotiations
- Sale in execution management
1.2 Debt collections for the Bank, which includes drafting of pleadings, attending case
management conferences, and court appearances on behalf of the Bank at subordinate courts.
1.3 Monitoring and supervising the Bank’s external attorneys to ensure that they carry out
outsourced duties diligently and timeously.
1.4 Execution of decisions regarding early identification of high risk arrears accounts and
proactively manage arrears of assigned portfolio.
1.5 Implementation of formulated repayment strategies/loan restructures for problem
cases and following through to ensure successful implementation of the same.
1.6 Implementing and driving action plans for the effective management of non-performing loans.
1.7 Supporting the Centralised Collateral Compliance Team in establishing the current
status of security and in the formulation and implementation of the best strategy for
recovery.
1.8 Collection of Loans “in default” and or “non-performing” through an agreed work out
and an appropriate recovery strategy which involve Legal Action.
1.9 Preparation and presentation of reports to management.
1.10Ensuring minimisation of valid audit queries regarding conformity to legislation / bank policies and regulations.
1.11Reconciling Legal Accounts to General Ledger Accounts.
1.12Reads and ensures understanding of relevant material in order to comply with laid down rules and regulations, Bank Policies, legislative, regulatory and statutory requirements.
2. Customer Focus
· Effectively liaises with external partners (legal, valuations, tracers etc.) in management process to optimise recovery strategies.
· Effectively liaises with internal parties (business, collateral) in formulation and implementation of the best strategy for recovery.
· Ensures that the unit is in a state of operational readiness through effective maintenance of premises, equipment and furnishing.
· Effectively liaises with group legal services and forensics regarding irregularities, litigation and any other contentious issue that poses a financial and / or reputational risk to the Bank.
3. People Management
3.1 Job Descriptions & Performance Contracts
· Ensures that all Direct Reports have agreed and signed for their job descriptions.
· Ensures that performance objectives are developed and that Performance. Contracts are agreed and signed on an annual basis.
· Gives internal training, mentoring and coaching as may be necessary.
3.2 Performance Management
· Conducts Performance evaluation for the Direct Reports on half yearly basis, using the agreed performance contracts.
· Submits annual Performance Evaluation Reports to Human Resources Department through Manager: Legal Collections.
· Identifies and manages poor performers as per the bank’s policy.
3.3 Staff Development
· Identifies skills gaps for Direct Reports and recommends appropriate training.
· Assists direct reports to develop and implement Personal Development Plans on annual basis
3.4 Staff Leave Management
· Develops the Legal Collections unit leave plan for the year, and submits to Human Resources Department, ensuring compliance with regulatory requirements and the bank’s leave policy.
3.5 Staff discipline
· Ensures departmental adherence to the bank’s Code of Conduct and Disciplinary Policy
5. EXPERTISE
Adequate knowledge of Banks products and services, as well as credit principles.
6. COMPLIANCE
Reads and ensures understanding of the relevant material in order to comply with laid down rules and regulations, Bank Policies and legislative, regulatory and statutory requirements.
